After the three-year sentence to Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan in the Tosha Khana case, the Election Commission of Pakistan has issued a notification disqualifying the former prime minister for five years.
According to a notification issued by the Election Commission, in line with the decision announced on August 5, 2023, by Additional Sessions Judge Islamabad, Imran Khan has been disqualified for a period of five years.
The statement mentioned that Imran Khan has been declared ineligible under Article 63(1)(h) of the Constitution of Pakistan, thus he is disqualified for a period of five years.
After this ban, Chairman PTI has been de-notified as a candidate from NA-45 Kuram 1 seat.
It should be noted that last week, in the Tosha khana case, the Islamabad District and Sessions Court had sentenced Chairman of Pakistan Tehreek-e-Insaf, Imran Khan, to three years of imprisonment and fined him one lakh rupees.
In the Islamabad District and Sessions Court, Judge Humayun Dilawar had passed a verdict against Chairman PTI Imran Khan in response to the Election Commission’s request related to the Toshakhana case. The verdict stated that “the court is satisfied that the petitioner (Election Commission) has presented effective and credible evidence and has proven the crime against the accused (Imran Khan) that he committed corrupt practices through false declarations regarding illicit receipts from Tosha khana and utilization of falsely declared assets during 2018-2019 and 2019-2020.”
The judge had said that Imran Khan had provided ‘wrong declaration’ in Form B regarding assets and expenses which were submitted to the Election Commission in 2020-2021.
The verdict had said, “By concealing benefits derived from the national exchequer, corrupt practices are committed, and they have attempted deception by providing details of benefits obtained from Tosha khana, which were later proved to be false.”
Regarding this matter, it was further stated, “Their bad intentions have been proven beyond any doubt.”
Judge Humayun Dilawar, while rejecting the request for the case of Tosha khana to be inadmissible, had imposed a sentence of three years of imprisonment and a fine of one lakh rupees on Chairman PTI Imran Khan.
