During the hearing, the Chief Justice stated that whether it’s legislation by Parliament or a decision by the Supreme Court, someone has to sit on the camel. The Chief Justice emphasized that the Supreme Court’s decision on disqualification and the Election Act cannot proceed simultaneously.
The Chief Justice said that the real disqualification is in Article 63, in Article 63-1G, the disqualification of the person who destroys Pakistan is 5 years. Disqualification for moral offense under Article 63 1H is 3 years.
During the hearing, the Chief Justice asked why Mir Badshah Qaisrani was disqualified. On which the lawyer petitioner said that he was disqualified in 2007 on the basis of fake degree but the High Court allowed him to contest the 2018 elections, he was disqualified under Article 62 1F.
Chief Justice, while making remarks, stated that Article 62 1F remains silent on the duration of disqualification. He emphasized that honesty is attributed to only one personality; no one else can attain that level. Not everyone speaks the truth all the time.
