The Supreme Court rejected the plea of the People’s Party for recounting in Balochistan Constituency PB-14 and allegations of favoritism by the Returning Officers.
A three-member bench headed by Chief Justice Qazi Faiz Isa heard the case, the Supreme Court rejected the petition of People’s Party candidate Ghulam Rasool and upheld the victory of Muhammad Khan Lahri of Muslim League (N).
Advocate petitioner Shahid Rasool said that he filed a recount application at 7 polling stations out of 96 polling stations.
The Chief Justice asked the petitioner how did you know that the wrong result was produced. The lawyer said that these were not the results as per Form 45 and the officers were biased.
Chief Justice Qazi Faiz Isa remarked that after the box is opened form 45 or 75 is no longer valid, the most important evidence in elections is the vote, form 45 is filled by the presiding officer, who either objects to the recount or The boxes were open.
Justice Shahid Bilal remarked that the record does not prove your allegations, the case is very simple, lawyer Shahid Rasool took the position that the judge called me a liar in the judgment without any evidence.
Justice Qazi Faiz said that Allah knows false and true, we decide on facts, it is not a case of husband and wife who will decide true and false, it is decided on record.
The Chief Justice asked the petitioner’s lawyer to prove the bias of the presiding officers and tell them whether they were relatives. No allegations are made on the recount, even if the presiding officer is a mortal enemy, the decision is made by vote, and the 45 form before the votes has no significance.
The lawyer took the stand that the presiding officers committed the entire fraud, and the Chief Justice said that do not make the same accusation, state the law, or any fact. Later, the court rejected the recount plea and upheld the victory of PML-N candidate Muhammad Khan Lehri.
