Islamabad: The Supreme Court has issued an important verdict regarding review petitions, clarifying that not every judicial decision can be reopened. The decision was delivered by a bench consisting of Justice Mansoor Ali Shah, Justice Muhammad Ali Mazhar, and Justice Shahid Bilal Hassan.
The verdict states that a review is only possible when there is a clear legal or technical error in the decision. Disagreement with a decision by a party is not a valid reason for review. The court also mentioned that arguments that were rejected in the initial case cannot be reintroduced in a review petition.
The court expressed concern, stating that millions of cases are pending across Pakistan, with over 56,000 cases still under consideration in the Supreme Court, a significant number of which involve unnecessary review petitions. The court emphasized that such cases waste judicial time and should be discouraged.
Meanwhile, today the Supreme Court is hearing review petitions related to specific seats. These are the same seats for which the court ordered PTI to be given representation in July 2023. Review petitions have been filed against this decision.
The case will be heard by a full court bench of 13 judges, led by Justice Syed Ameenuddin Khan. Interestingly, Justice Mansoor Ali Shah, who had written the original decision, is not part of this hearing.
