In the Punjab Election Revision Case, the Supreme Court remarked that where it is written in the Constitution that the caretaker government can be extended, the extension of the caretaker government is against the spirit of the Constitution.
The Supreme Court has begun hearing the Election Commission’s review petition regarding the Punjab elections. A three-member bench headed by Chief Justice Umar Ata Bandial is conducting the hearing, with Justice Ejaz ul Hassan and Justice Muneeb Akhtar also present on the bench.
Advocate Sajeel Swati, representing the Election Commission, appeared in the courtroom. In response, the Chief Justice remarked, “It’s the third day, and we are hearing the arguments of the Election Commission’s counsel. Please inform us of your main point.”
Advocate Sajeel Swati, representing the Election Commission, stated that the Supreme Court cannot diminish the constitutional powers.
Justice Ejaz ul Hassan commented, “How does the Supreme Court diminish the judicial constitutional powers? We have taken note of the points raised so far. Please proceed.”
The Election Commission’s counsel mentioned that the Full Court has given decisions in several cases, stating that the scope of review is not limited.
The court remarked, “If we accept your logic, then the Supreme Court rules will become null and void.”
