Islamabad: A significant letter by Justice Sardar Ejaz Ishaq Khan regarding the use of artificial intelligence in the judiciary has surfaced, shedding light on his stance following the recent full court meeting.
According to reports, copies of the letter addressed to Chief Justice Sarfraz Dogar have been circulated among all judges of the Supreme Court. In the letter, Justice Ejaz Ishaq Khan expressed his detailed opinion on the potential role of artificial intelligence within judicial systems.
He wrote that the use of AI in courts is being widely debated across the world. However, critics argue that since artificial intelligence is programmable, any robots placed in positions of justice would be bound by their programming rather than independent reasoning.
Justice Ishaq stated that such machines would always make decisions based on the data and codes periodically fed into them. As a result, they would lack the capacity for moral judgment or independent interpretation of truth.
He further revealed that, although he previously disagreed with this perspective, his views changed after the full court meeting, and he now aligns himself with critics who oppose the use of AI as a decision-maker in judicial proceedings.
Justice Ishaq also mentioned his agreement with the dissenting opinions presented by Justice Mohsin Akhtar Kayani and Justice Saman Riffat Imtiaz during the full court session.
