The Supreme Court upheld the decision of the special court regarding the death sentence of late former Prersident Pervez Musharraf and declared it correct.
Former Chief Justice of the Peshawar High Court, Seth Waqar, had presided over a special court that had sentenced former president Pervez Musharraf to death in absentia in a high treason case. However, at the time of the death penalty verdict, Pervez Musharraf was not present in the country; he was undergoing medical treatment in the United Arab Emirates, where he eventually passed away.
Against this decision of the special court, a three-member bench of the Lahore High Court declared the creation of a special bench to hear the case of violation of the constitution as unconstitutional.
The three-member bench of the Lahore High Court included Justice Mazahir Akbar Naqvi, who was appointed a judge of the Supreme Court some time after this decision.
The Pakistan Bar Council had filed an appeal in the Supreme Court against this decision of the Lahore High Court, which was heard today along with Pervez Musharraf’s appeal.
